Terms and Conditions
1. Services
Saltwell Studio provides professional audio services including:
Recording
Mixing
Music Production
Audio editing and related creative services
Project scope will be agreed in writing (email is sufficient) before work begins.
2. Bookings and Payment
2.1 All bookings must be paid for in full in advance.
2.2 An invoice will be issued confirming the session date(s), and full payment must be received by the payment date stated on the invoice.
2.3 Bookings are not confirmed until full payment has been received.
2.4 Saltwell Studio reserves the right to cancel or release any booking where payment has not been received by the stated due date.
2.5 The Studio reserves the right to withhold delivery of any recordings, mixes, masters, or project files until full payment has cleared.
3. Cancellation and Rescheduling
3.1 All bookings are paid for in full in advance and secure the agreed session date(s) exclusively for the Client.
3.2 Where the Client provides more than 72 hours’ notice prior to the scheduled session, the Studio may, at its sole discretion, offer one rescheduled date, subject to availability.
3.3 Where the Client provides less than 72 hours’ notice, the booking fee is non-refundable and non-transferable.
3.4 Failure to attend a confirmed session (“no-show”) will result in the full booking fee being retained.
3.5 If the Studio is required to cancel due to circumstances within its control, the Client will be offered either:
A full refund; or
A rescheduled session at no additional charge.
3.6 The Studio shall not be liable for cancellation due to events beyond its reasonable control (see Force Majeure clause).
4. Fees and Payment Terms
4.1 All prices are quoted in GBP (£).
4.2 Payment methods accepted: bank transfer.
4.3 In accordance with the Late Payment of Commercial Debts (Interest) Act 1998, the Studio reserves the right to charge statutory interest and reasonable recovery costs on overdue invoices.
4.4 Prices may be updated periodically, but confirmed bookings will be honoured at the agreed rate.
5. Studio Time and Overtime
5.1 Session time includes setup, recording, editing, breaks, and pack-down unless agreed otherwise.
5.2 Overtime is charged at the agreed hourly rate and is subject to availability.
5.3 The Client must vacate the premises at the agreed end time unless overtime has been authorised.
6. Revisions (Mixing & Mastering)
6.1 All mixing and mastering services include up to two (2) rounds of reasonable revisions unless otherwise agreed.
6.2 Additional revisions are charged at the Studio’s hourly rate.
6.3 Major structural changes (including new arrangement, re-recorded parts, or tempo changes) may constitute a new project and incur additional charges.
7. Intellectual Property & Ownership
7.1 The Client retains ownership of their original compositions and performances.
7.2 Full rights to final recordings are transferred to the Client only once full payment has been received.
7.3 Where Saltwell Studio contributes to songwriting, composition, or substantial creative production, publishing splits and/or royalty arrangements must be agreed in writing prior to release.
7.4 The Studio retains ownership of session templates, production techniques, and internal workflows.
8. Credits and Promotion
8.1 The Studio reserves the right to use excerpts (up to 60 seconds) of completed and released projects for showreel, website, and promotional purposes.
8.2 Where possible, credit should be given as:
“Produced/Mixed/Mastered by Chris Pepper at Saltwell Studio.”
8.3 If a project is confidential prior to release, the Client must notify the Studio in writing.
9. File Storage and Data
9.1 Session files will be retained for 30 days after final delivery unless otherwise agreed.
9.2 Long-term archiving is not guaranteed.
9.3 Clients are responsible for maintaining their own backups after receiving final files.
9.4 Saltwell Studio is not liable for data loss after files have been delivered.
10. Client Responsibilities
10.1 Clients must ensure they have the legal right to record and distribute all material brought into the Studio.
10.2 Clients are responsible for clearing samples, third-party compositions, and performer permissions.
10.3 The Client is liable for any damage caused to Studio equipment or premises by themselves or their guests.
11. Limitation of Liability
11.1 Saltwell Studio shall not be liable for:
Loss of profits
Loss of opportunity
Indirect or consequential loss
11.2 Total liability shall not exceed the total fees paid for the relevant project.
Nothing in these Terms limits liability for death or personal injury caused by negligence or for fraud.
12. Conduct and Right to Refuse Service
12.1 Abusive, aggressive, discriminatory, or illegal behaviour will not be tolerated.
12.2 The Studio reserves the right to terminate a session without refund if conduct is deemed unsafe or inappropriate.
13. Force Majeure
Saltwell Studio shall not be liable for delays or failure to perform services due to events beyond reasonable control, including power outages, equipment failure, illness, government restrictions, or acts of God.
14. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Acceptance
By confirming a booking, paying an invoice, or instructing Saltwell Studio to commence work, the Client confirms acceptance of these Terms and Conditions.
